Submitting a Notice

To be effective under 17 U.S.C. § 512(c)(3), your notice must include substantially the following:

  1. A physical or electronic signature of the copyright owner or a person authorized to act on their behalf.
  2. Identification of the copyrighted work claimed to have been infringed.
  3. Identification of the material claimed to be infringing, with information reasonably sufficient to permit us to locate it.
  4. Your name, address, telephone number, and email address.
  5. A statement that you have a good-faith belief that the use is not authorized by the copyright owner, its agent, or the law.
  6. A statement, made under penalty of perjury, that the information in the notice is accurate and that you are the copyright owner or authorized to act on the owner’s behalf.

Incomplete notices may not be actionable. If you are unsure whether the material is authorized, you may wish to consult an attorney.

What Happens Next

When we receive a notice we determine in good faith to be valid, we will expeditiously remove or disable access to the material and take reasonable steps to notify the user who supplied it.

Counter-Notification

If you believe your material was removed or disabled by mistake or misidentification, you may submit a counter-notification containing the elements required by 17 U.S.C. § 512(g)(3). We may restore the material in 10 to 14 business days unless the original complainant notifies us that they have filed an action seeking a court order.

Repeat Infringers

In accordance with 17 U.S.C. § 512(i), we have adopted and reasonably implement a policy of terminating, in appropriate circumstances, the accounts of users who are repeat infringers. Accounts that accumulate repeated valid notices may lose sharing privileges and may be suspended or terminated.

This policy forms part of your agreement with us — see Section 6.5 of our Terms of Service.

Misrepresentation

Under 17 U.S.C. § 512(f), any person who knowingly materially misrepresents that material is infringing, or that material was removed or disabled by mistake, may be liable for damages, including costs and attorneys’ fees.
